  • “Company”, “we”, “us”, “our” refers to Total Care Disability Services Pty Ltd, a registered NDIS service provider operating in New South Wales, Australia.

  • “Services” refers to all disability support services we provide, including but not limited to: NDIS Plan Management, Support Coordination, Community Nursing, Supported Independent Living (SIL), Respite Care, Community & Social Participation, and Assistance with Daily Life.
  • “You”, “your”, “participant”, “client” refers to any person, carer, guardian, or authorised representative who accesses our website, engages with our services, or enters into a service agreement with us.
  • “NDIS” refers to the National Disability Insurance Scheme as legislated and governed in Australia. 

2. Acceptance of Terms

By using our website or engaging our services, you confirm that you:

  1. Are at least 18 years of age, or are under the care of a parent/guardian who consents to these Terms.
  2. Understand that our services are provided under the NDIS framework and subject to relevant Australian laws and regulations.
  3. Acknowledge that these Terms apply to both online use of our website and offline service agreements.
 

We may update these Terms at any time without prior notice. Any changes will take effect once published on our website. Continued use of our website or services after updates constitutes acceptance of the revised Terms.

3. Eligibility and Use of Services

Our services are intended for NDIS participants, carers, and families within Blacktown, Western Sydney, and surrounding regions, though we also support participants across broader New South Wales and Australia.

You must ensure that:

  • You provide accurate, complete, and current information when engaging our services.
  • You are eligible to receive NDIS funding or have made alternative arrangements for payment.
  • You comply with any agreements or service bookings entered into with our staff or representatives.
 

We reserve the right to refuse service or terminate service agreements if eligibility is not met or if misuse of services occurs.

4. NDIS Services and Funding Disclaimer

Total Care Disability Services operates as a registered NDIS provider. Our services are designed to comply with the NDIS Practice Standards and relevant Australian laws.

Important notes regarding NDIS funding:

  • We process invoices and manage allocations, but participants remain in control of their NDIS plan at all times.
  • NDIS funding covers the fixed costs of services such as plan management; there are no out-of-pocket expenses for participants for these items.
  • If disputes arise (e.g., a provider overcharges), our Service Manager may step in to protect your budget and resolve the issue.
  • We do not guarantee that all requested supports or services will be funded under your NDIS plan; this is subject to NDIA approval and plan allocations.

5. Intellectual Property Rights

Unless otherwise indicated, all content on our website — including text, graphics, logos, images, service descriptions, videos, icons, and software — is the property of Total Care Disability Services and is protected by Australian copyright and intellectual property laws.

You must not:

  • Copy, reproduce, republish, distribute, or exploit any content from our website for commercial purposes without prior written consent.
  • Misuse our brand name, logo, or trademarks in any way that may mislead or harm our reputation.
